American Citizen Getting Married in Italy Paperwork requirements

US citizens getting married in Italy must secure the following documents in the sequence they appear below:

  1. VALID U.S. PASSPORT or ID CARD if a member of the Army forces;
  2. A certified copy of your BIRTH CERTIFICATE in which appear the name of both parents. This document has to be translated into Italian and be APOSTILLED by the Secretary of State Notary Public where the document has been originated in. An Apostille is valid only for 6 months.   3. A FINAL DIVORCE DECREE(if applicable) or DEATH CERTIFICATE (if applicable)of the previous spouse. Same as above, this documents have to be translated into Italian and Apostilled.
  4. TRANSLATIONS must be certified by a Consular Officer and then Apostilled by the Secretary of State Notary Public of the State where they were certified in.   5. ATTO NOTORIO(can be done in USA or ITALY): Is a declaration sworn with 2 or 4 witnesses before an Italian Consular Officer stating that there are no obstacle for the marriage to take place. Call your nearest Italian Consulate and set up an appointment. Ask them how many witnesses are necessary. IMPORTANT: The Atto Notorio is valid only for 3 months.   6. NULLA OSTA or SWORN STATEMENT(To be done only in Italy): This document is issued by the US Consulate (either Rome, Milan, Genoa, Trieste, Florence or Naples). No witnesses are necessary. This document states that there are no obstacle according to US laws for the marriage to be performed in Italy. The document once issued has to be authenticated at the Prefettura (Law Court) to be accepted by the Italian Authorities.
